The Family and Medical Leave Act (FMLA) process is both complex and administratively burdensome. The FMLA affects companies with over 50 employees. The Department of Labor (DOL) issued a 20-page summary titled “Need Time? The Employee’s Guide to the Family and Medical Leave Act.” (see attached PDF). The Employee Guide includes flow charts that detail how FMLA coverage works and how eligibility is determined. Employers should make this booklet available to their employees. Download the FMLA Guide For Employers.
The Guide specifically addresses:
- Who can use FMLA? (Coverage and Eligibility)
- When can I use FMLA? (Qualifying reasons to take FMLA)
- What can the FMLA do for me? (FMLA rights and protections)
- How do I request FMLA leave?
- Communication with Employer (Employer and Employee Notices)
- Medical Certification
- Returning to Work (Reinstatement rights)
- How to File a Complaint
